鈥淲hen the Affordable Care Act was first challenged legal scholars overwhelmingly predicted that the courts would easily uphold its provisions against constitutional challenges. This view was based on long standing precedents that give Congress, a branch of government directly accountable to the people via elections, significant discretion in addressing national economic issues. The possibility that the Supreme Court may nevertheless overturn part or all of the Act reflects the deep political and philosophical divide on the Court over the power of the federal government. A decision overturning the Act would signal a dramatic shift in the Court鈥檚 approach to such issues.鈥
